A number of law enforcement officials on the southwest border, along with two members of Congress, have asked the Department of Defense to send surplus military equipment from the war in Iraq to the southern border in an effort to bolster security in the region.
Congressmen Ted Poe (R-Humble) and Henry Cuellar (D-Laredo), both from Texas, along with sheriffs from Texas, New Mexico and Arizona sent a letter last month to Defense Secretary Leon Panetta asking for a more militarized approach to securing the U.S.-Mexico border from drug cartel violence.
“These criminals show no hesitation in using violence to intimidate law enforcement in Mexico and what was once a regionally isolated criminal justice matter has grown into a significant national security concern for the U.S. and Mexico,” the letter stated.
“With the drawdown of U.S. troops and equipment in Iraq, and our role in Afghanistan winding down, it is to be expected that in the next few years there will be a significant amount of surplus equipment that will become available that could be extremely beneficial for border security operations,” the letter added.

Attorney General Eric Holder acknowledged Wednesday that the "courts have final say," and said his department would respond formally to an appeals court order to explain whether the Obama administration believes judges in fact have the power to overturn federal laws. 
The attorney general, at a brief press conference in Chicago, made clear the administration thinks they do. 
"We respect the decisions made by the courts since Marbury v. Madison," Holder said Wednesday, referring to the landmark 1803 case that established the precedent of judicial review. "Courts have final say."

One of the highly developed talents of President Barack Obama is the ability to say things that are demonstrably false, and make them sound not only plausible but inspiring.

That talent was displayed just this week when he was asked whether he thought the Supreme Court would uphold ObamaCare as constitutional or strike it down as unconstitutional.

He replied: "I'm confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress."

But how unprecedented would it actually be if the Supreme Court declared a law unconstitutional if it was passed by "a strong majority of a democratically elected Congress"?

The Supreme Court has been doing precisely that for 209 years!

Nor is it likely that Barack Obama has never heard of it. He has a degree from the Harvard law school and taught constitutional law at the University of Chicago law school. In what must be one of the most famous Supreme Court cases in history — Marbury v. Madison in 1803 — Chief Justice John Marshall established the principle that the Supreme Court can declare acts of Congress null and void if these acts violate the Constitution.

They have been doing so for more than two centuries. It is the foundation of American constitutional law. There is no way that Barack Obama has never heard of it or really believes it to be "unprecedented" after two centuries of countless precedents.

In short, he is simply lying.

 USDA Orders 326,000 Rounds of Ammunition As Homeland Security Stays Quiet Over 450 Million Round Order

In the last few weeks the fact that the Department of Homeland Security recently ordered 450 million rounds of hollow point ammunition (which was on top of the 2 million ordered in 2009) has been heavily discussed by numerous alternative media outlets.

For their part, the corporate controlled media and the DHS itself have chosen to stay quiet, refusing to answer inquiries as to why they need millions of hollow point bullets at a time when they are largely focusing on domestic operations.

A recent report by RT highlighted this fact:

The DHS has signed off on an “indefinite delivery” from defense contractors ATK that will include, for some reason, nearly 500 million high-power ammunition for .40 caliber firearms.
The department has yet to discuss why they are ordering such a massive bevy of bullets for an agency that has limited need domestically for doing harm, but they say they expect to continue receiving shipments from the manufacturer for the next five years, during which they plan to blow through enough ammunition to execute more people than there are in the entire United States.
“We are proud to extend our track record as the prime supplier of .40 caliber duty ammunition for DHS,” reads an official statement from Ron Johnson, ATK’s president of Security and Sporting, who adds that his group will also be giving up weaponry to the DHS subdivision of ICE, or Immigrations and Custom Enforcement.
While ammunition itself seems not too unreasonable of a request by a major federal entity that emphasizes domestic durability and safeguarding the country from coast to coast, the choice — and quantity — of its hollow point order raises a lot of questions about future plans for the DHS.
ATK says they won their contract with the US government by being able to provide them with 450 million HST bullets, which it describes as “the next generation in high performance duty ammunition.”

Apparently Homeland Security is not the only domestic government agency that has bought a large amount of ammunition in the last 7 months.

Arizona lawman Joe Arpaio reminded everyone why he’s considered “America’s toughest sheriff” when he took a Fox News anchor to task in a live interview this afternoon.

Appearing on “America Live” with Megyn Kelly, Arpaio told Kelly she was wrong in some of her reporting about a federal investigation into his treatment of Hispanics in Maricopa County, Ariz.

The U.S. Justice Department is looking into allegations of racial profiling, a charge Arpaio denies, and the federal government wants Arpaio to allow an independent monitor to oversee the conduct of his office.

The Obama administration announced it’s now preparing to sue Arpaio. The Justice Department has said negotiations have broken down with the sheriff, who also believes President Obama’s birth certificate and Selective Service card are likely forgeries.

Though Kelly never mentioned concerns over Obama’s eligibility in her interview, she did ask Arpaio why it would be a deal-breaker to have a federal monitor in his presence to make sure everything in his county office were “legit.”

OBAMA'S DHS To Grant Illegal Aliens “Unlawful Presence Waivers” IF THEY ANSWER THE QUESTION "ARE YOU GONNA VOTE DEMOCRAT ?"

In its quest to implement stealth amnesty, the Obama Administration is working behind the scenes to halt the deportation of certain illegal immigrants by granting them “unlawful presence waivers.”

The new measure would apply to illegal aliens who are relatives of American citizens. Here is how it would work, according to a Department of Homeland Security (DHS) announcement posted in today’s Federal Register, the daily journal of the U.S. government; the agency will grant “unlawful presence waivers” to illegal aliens who can prove they have a relative that’s a U.S. citizen.

Currently such aliens must return to their native country and request a waiver of inadmissibility in an existing overseas immigrant visa process. In other words, they must enter the U.S. legally as thousands of foreigners do on a yearly basis. Besides the obvious security issues, changing this would be like rewarding bad behavior in a child. It doesn’t make sense. 

But the system often causes U.S. citizens to be separated for extended periods from their immediate relatives,” according to the DHS. The proposed changes, first announced in January, will significantly reduce the length of time U.S. citizens are separated from their loved ones while required to remain outside the United States during the current visa processing system.

The administration also claims that relaxing the rule will also “create efficiencies for both the U.S. government and most applicants.” How exactly is not listed in the Federal Register announcement, which gives the public 60 days to comment. That’s only a formality since the DHS has indicated that the change is pretty much a done deal.

This appears to be part of the Obama Administration’s bigger plan to blow off Congress by using its executive powers to grant illegal immigrants backdoor amnesty. The plan has been in the works for years and in 2010 Texas’s largest newspaper published an exposé about a then-secret DHS initiative that systematically cancelled pending deportations. The remarkable program stunned the legal profession and baffled immigration attorneys who said the government bounced their clients’ deportation even when expulsion was virtually guaranteed.

In late 2011 a mainstream newspaper obtained internal Homeland Security documents outlining “sweeping changes” in immigration enforcement that halt the deportation of illegal aliens with no criminal records. This also includes a nationwide “training program” to assure that enforcement agents and prosecuting attorneys don’t remove illegal immigrants who haven’t been convicted of crimes. 

Judicial Watch has been a front runner in investigating the Obama Administration’s stealth amnesty program by pursuing DHS records concerning “deferred action” or “parole” to suspend removal proceedings against a particular group of individuals. Last spring JW sued DHS to obtain information because the agency ignored a federal public records request that dates back to July 2010.

FIVE EX POLICE OFFICERS SENTENSED TO UP TO 65 YEAR FOR SHOOTINGS AFTER KATRINA

NEW ORLEANS—Five former New Orleans police officers were sentenced Wednesday to prison terms ranging from six to 65 years for their roles in deadly shootings of unarmed residents on a bridge after Hurricane Katrina.

Kenneth Bowen, Robert Gisevius, Anthony Villavaso and Robert Faulcon were convicted of firearms charges in the shootings. Retired Sgt. Arthur "Archie" Kaufman, who was assigned to investigate the shootings, was convicted of helping orchestrate the cover-up.

Mr. Faulcon received the stiffest sentence of 65 years. Messrs. Bowen and Gisevius each got 40 years while Mr. Villavaso was sentenced to 38 years. Mr. Kaufman received the lightest sentence at six years.

A federal jury convicted the officers in August 2011 of civil-rights violations in the shootings on the Danziger Bridge and the cover-up.

Police shot six people, killing two, less than a week after the storm's landfall on Aug. 29, 2005. To make the shootings appear justified, officers conspired to plant a gun, fabricate witnesses and falsify reports.

The case became the centerpiece of the Justice Department's push to clean up the troubled New Orleans Police Department.

U.S. District Kurt Engelhardt heard hours of testimony earlier in the day from prosecutors, defense attorneys, relatives of shooting victims and the officers.

Obama delivered a luncheon speech today to the Associated Press.  It was so absolutely dreadful that you just have to laugh.

Obviously the White House is in full panic mode after the president’s perfectly awful week last week. It hadn’t occurred to them that it was possible that ObamaCare could possibly be struck down. Nobody expected Obama to be selling out the country in a whispered conversation caught by a hot mic. And the president’s budget request was shot down without even a single Democrat vote.
Obama has railed against the Supreme Court, reminding them that they must observe precedent and not go ruling against him. Now he’s taking on Paul Ryan’s Path to Prosperity. The nasty Republicans are threatening to “spend $4.6 trillion on lower tax rates.” This reveals the president’s mindset. Allowing people to keep more of their own hard-earned money is “spending.” Government taking more of the peoples’ hard-earned money to spend on current government enthusiasms is “investing.”

Dear Jon,
If it weren’t for the unique spelling or your name, this could be mistaken for the traditional break-up letter (except for the fact, ironically, that we are both “traditional” males).  In order for one to end a “relationship,” however, it would first be necessary that there be one – which in this case there most certainly has not been….
You see, Jon, while I have the utmost confidence that you are an upstanding citizen and a decent person (and have probably been one throughout most of your life),  I am not familiar with your life narrative…which segues nicely into my reason for writing. But first to the point of your presumed decency or proclivity for deference, Senator.  When you were a young man that was certainly a trait to be admired – and it is still, I believe, the best first response.  When one realizes, however, that we are no longer dealing with a group or an individual who simply has a bit more of a “working-man’s” (or blue-collar) perspective on politics, but rather a group of people who are actively seeking to “fundamentally transform” this nation into a “workers’ paradise” (and Fundamentalist Marxist State), the time for nicities vanishes…or at least it should, Jon!  We are at war…and we will either remain free or, as promised, be “transformed” into something that most Americans, including this one, will never accept!
You recently took the time to send a personal – although I’m sure it was, in the end, a form – letter to a friend of mine, Gabe Zolna, in response to his inquiry regarding what you planned to do about the bullet-proof Arpaio Investigation results.  It just so happened that he showed me your letter as we were leaving to go to the Arpaio Press Conference in Sun City West, this past Saturday, March 31, 2012.  We were saddened (but not surprised), to find you – or any of the AZ Congressional delegation – not in attendance.

Pentagon has no records of Osama bin Laden’s death

Fellowship of the Minds The Pentagon said it could not find any death certificate, autopsy report or results of DNA identification tests for bin Laden, or any pre-raid materials discussing how the government planned to dispose of bin Laden’s body if he were killed.

It said it searched files at the Pentagon, U.S. Special Operations Command in Tampa, Fla., and the Navy command in San Diego that controls the USS Carl Vinson, the aircraft carrier used in the mission.

Obama touts the Navy SEALS’ raid and killing of Osama bin Laden in his hideaway compound in Abbotabad, Pakistan, as one of, if not the greatest, achievements of his administration. Reportedly, the administration even disclosed details of the raid to Hollywood for an upcoming movie, Zero Dark Thirty, directed by Kathryn Bigelow.

The movie is scheduled to be released — SURPRISE! — on October 12, 2012, within a month of the presidential election.

Joseph Straw reports for the N.Y. Daily News, Aug. 11, 2011, that the CIA defended its collaboration with the maker of Zero Dark Thirty. CIA spokesman Preston Golson said that such collaboration with filmmakers has precedent and is part of the CIA’s “public outreach.” Despite the CIA’s insistence, Congressman Peter King (R-Long Island), chairman of the House Homeland Security Committee, has demanded that the Pentagon and CIA inspectors general investigate whether the agencies breached policy in this case, in particular whether the filmmakers saw classified material or got access to personnel working under cover.

If the U.S. Supreme Court tosses out Obamacare, radio giant Rush Limbaugh predicts President Obama will blame Republican justices, whose homes might become the target of political protest.

“Obama’s gonna make tracks for the first microphone and camera and he’s going to say something like this,” Limbaugh said this afternoon.

“‘For 60 to 75 years, we have been struggling to achieve fairness and justice for all people in this country, not just the privileged few. We’ve recognized that the way health care has existed in this country is emblematic of the injustice and the discrimination that has defined this country since its beginning. And look what happened. Republican judges just took away your health care. Republican judges just decided you were about to get too big a piece of the pie. Republican judges determined that you’re not important enough to have health care.’ And then he’ll throw in, ‘We’ve seen similar struggles since the days of Jim Crow’ or throw in some identifier, throw in some code word. And then he’ll relate the loss of health care to civil-rights battles that have occurred. And he’ll do this in his best professorial voice. And he in the process will be lighting another fuse.”

Immigration Statistics Show SB 1070 is Working

Last week, the Department of Homeland Security released their statistics on the illegal immigration for 2010. According to DHS, the total illegal population went down less than 1%, from 11.6 million at the beginning of the year to 11.5 million by the end. However, in the state of Arizona, the illegal population declined from 470,000 to 360,000; a decline of 23%. In April of 2010 the Arizona legislature passed SB 1070 to crack down on illegal immigration in the state. While parts of the law were blocked by a federal judge, illegal aliens in Arizona are getting the message that they are not welcome and left.

Opponents of SB 1070 recognize this. Also last week, the Supreme Court published the amicus brief it received from 11 Democratic Attorney Generals from states including Massachusetts, California, Illinois, and New York in opposition to SB 1070. Many of these states enacted sanctuary policies that forbid local law enforcement from cooperating with federal immigration authorities, even when illegal aliens are convicted of serious crimes. Not surprisingly illegal immigrants are attracted to these states, so they complain that “SB 1070’s provisions have the primary effect of redirecting

 undocumented immigrants to other States.”

If that’s true, then residents of these sanctuary states should be furious at their politicians for making their states a magnet for illegal immigration, not at Arizona.

That being said, many of the illegal immigrants are leaving Arizona to their country of origin. While the declining in illegal population was most dramatic in 2010, the illegal population has fallen by

In today's disappointing speech

, the President made a series of claims that are simply false.
The President's attacks began with an admission that his assumptions reflect White House spin, not our budget's substance: “I want to go through what it would mean for our country if these cuts were to be spread out evenly."  Of course, the assumption that our budget makes these kinds of indiscriminate cuts is false. The House Budget Committee made dozens of specific assumptions to justify our numbers, and we made these assumptions public in the hundreds of pages of text we posted in plain view on the House Budget Committee’s website

. It’s not a “secret plan” to “never tell us where the knife may fall” – it is a specific plan to cut waste, eliminate programs that don’t work, end crony politics, and carefully prioritize hardworking taxpayers’ money in precisely the way leaders of the President’s party have refused to do

 for over three years. In a related vein, does this new standard allow for analyses of the President’s budget to go through what it would mean for the country if the President’s $2 trillion tax increase were to be spread out evenly?

 
Instead of using numbers from the actual

House-passed budget, the President’s claims relied on false assumptions created out of thin air by the White House.
As a matter of fact, it is actually the President’s budget that makes it far more likely that college students, the sick, mothers, young children, seniors and all Americans would face harsh disruptions in government services and indiscriminate cuts. By making our unsustainable fiscal trajectory worse, his budget guarantees a debt-fueled economic crisis, which would hurt society’s most vulnerable the first and the worst.

With respect the many false claims from today’s speech:

• CLAIM: The Path to Prosperity would gut “the very things we need to grow an economy that's built to last -- education and training; research and development.”
• REALITY:
• Education: The Obama administration’s policies have recklessly endangered the viability of the Pell program and helped fuel
  
  an unprecedented surge in tuition costs, which rose by over 8 percent last year. The Path to Prosperity aims to tackle the urgent problem of tuition inflation by encouraging innovation in higher education and making the Pell program sustainable. Contrary to the President’s false attacks, The Path to Prosperity maintains the maximum Pell award of $5,550.
• Job Training: The Obama administration’s track record in this area has been dismal: For instance, the  “green” skills training program, funded by $500 million in stimulus funds, that resulted in a mere 2 percent
  
  of trainees retaining jobs for more than six months. The Path to Prosperity advances reforms to increase job-training outcomes across the board by calling for the streamlining of duplicative federal job-training programs into a strengthened workforce development system with fewer funding streams that provide accountable, targeted career scholarship programs.
• Research and Development: The Obama administration has steered government away from investments in basic research and toward investments in specific companies, often controlled by top donors
  
  to the Democratic Party. The Path to Prosperity would continue funding essential government missions, including energy security and basic research and development, while putting an end to the administration’s crony politics. The Path to Prosperity rejects the administration’s insistence on taking from hardworking taxpayers in order to fuel special interest favoritism, like its failed ‘investments’ in specific companies like the now-bankrupt solar company Solyndra.

Federal Reserve Chairman Ben Bernanke remarked on the U.S. unemployment rate early Monday to the National Association for Business Economics. He noted the economy must grow much more quickly than is its current pace to make any dent in the percent of unemployed individuals in the U.S.

Appeals court fires back at Obama's comments on health care case

(CBS News) In the escalating battle between the administration and the judiciary, a federal appeals court apparently is calling the president's bluff -- ordering the Justice Department to answer by Thursday whether the Obama Administration believes that the courts have the right to strike down a federal law, according to a lawyer who was in the courtroom.
The order, by a three-judge panel of the U.S. Court of Appeals for the 5th Circuit, appears to be in direct response to the president's comments yesterday about the Supreme Court's review of the health care law. Mr. Obama all but threw down the gauntlet with the justices, saying he was "confident" the Court would not "take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress."
Overturning a law of course would not be unprecedented -- since the Supreme Court since 1803 has asserted the power to strike down laws it interprets as unconstitutional. The three-judge appellate court appears to be asking the administration to admit that basic premise -- despite the president's remarks that implied the contrary. The panel ordered the Justice Department to submit a three-page, single-spaced letter by noon Thursday addressing whether the Executive Branch believes courts have such power, the lawyer said.
The panel is hearing a separate challenge to the health care law by physician-owned hospitals. The issue arose when a lawyer for the Justice Department began arguing before the judges. Appeals Court Judge Jerry Smith immediately interrupted, asking if DOJ agreed that the judiciary could strike down an unconstitutional law.
The DOJ lawyer, Dana Lydia Kaersvang, answered yes -- and mentioned Marbury v. Madison, the landmark case that firmly established the principle of judicial review more than 200 years ago, according to the lawyer in the courtroom.

Dear Mr. President,

Supposedly, you are some sort of constitutional scholar.  At the very least, you can read, you can write, and despite being merely some sort of guest lecturer at the University of Chicago Law School, you once famously referred to yourself as a “Constitutional Law professor.”
Ringing a bell so far, Mr. President? Great.
My Juris Doctor is from the Rutgers School of Law in Camden, New Jersey, and while Rutgers-Camden is hardly Harvard Law School, within the first three days of Constitutional Law class those who did not already know of and understand Marbury v. Madison–perhaps the single most important decision in the history of the United States Supreme Court–were nonetheless introduced to it ad nauseum.
In Marbury, the United States Supreme Court held that federal courts across our nation not only have the authority, but also the duty, to review the constitutionality of acts of Congress–including statutes and treaties–and to designate as void those acts of Congress which countermand the United States Constitution.  The term you’re searching for between those ears of yours, Mr. President, is “judicial review.”  And, while it has been nearly two years since I opened up a Constitutional Law book and can now debate divorce and family law in South Carolina better than I can the Constitution, I recall enough from law school and bar exam study to know that the doctrine of “judicial review” is now settled law.

You wouldn't know this from reading the mainstream media, which reported the disastrous summit with anodyne headlines like: "Obama talks trade, energy with Canada, Mexico leaders at Summit" (Associated Press) and "Obama, Mexico's Calderon vow more drug crime cooperation" (Reuters).
